Unless Edison had legal exposure for the economic damages the inevitable meltdown from the "vibrations" the corporations will act in their own self-interest. Price Anderson Act encourages operators to take bigger risks because their competitors are also cutting corners. The operators' liability is essentially a small deductible. US taxpayers would fund the payment of damages, such as they are, to the extent permitted under the Act. If SONGS melted down, residents of San Diego could not seek damages for their pain and suffering nor diminution in the value of their real estate. San Diegans would have to suck it up. Compare this to Filner Gate. There would be no Gloria Allred lotto-winners; just losers. Filner opposed the restart. I would prefer having my backside pinched for $5, 000,000 than having it nuked for nothing. Much credit goes to Barbara Boxer and those who worked at the grassroots level, including whistleblowers. This gets us back to the prejudicial pre-trial statements by City Attorney Goldsmith that Filner was a psychopath. Now the taxpayers will pick up the tab. The corporate welfare queens downtown rid themselves of Robin Hood. No more poaching for the plebs. Goldsmith has a conflict with the people. Filner doesn't mind. He won't have to pay. Coons or Aguirre have integrity; the rest of the Democrats are controlled by developers, Qualcom (Jacobs), or pro-development unions. Following the money through campaign contributions or "who benefits" reveals the "why" Filner had to be accused in this scandal. Likewise, who would be a compromised Democratic candidate in the Democratic mayoral special election can also be determined. Those candidates that have little name recognition have a disadvantage. Coons, therefore, has little time to get his message and face out there. Aguirre has negatives created by the U-T from his time in office as City Attorney. Neither Coons nor Aguirre have a big war chest. The Democratic party will be forced to back whomever the unions endorse. From the above analysis, it looks like the compromised Fletcher would emerge. Yes. 99% of lawsuits are unverified. Lawsuits are subscribed by a party or the attorney for the party. Then depositions are noticed. There is no requirement for swearing out the allegations. In fact, amendments might be made to conform to discovery. Verification of initial pleadings makes that more difficult. If you want a TRO or an injunction you could verify a complaint, otherwise, no. Discovery is the phase of the civil lawsuit where written questions may be submitted by a party to be answered under oath; Demands for Production of Documents; or Depositions before. Certified shorthand reporter (CSR or court reporter) may be taken. The remedy for false and malicious lawsuits is limited to lawsuits for malicious prosecution. Filing a lawsuit is not defamation, slander or libel. Unless the lawsuit was filed without probable cause and maliciously, the politician has little recourse.— September 12, 2013 1:52 p.m.
