Tentative Ruling: Judge Won't Throw Out Kessler Suit
If they do settle behind closed doors, do you know if the City will have to make all the conditions of the settlement public, since the City voters will have to "foot the bill once again"? ============= The city will try to insert a confidentiality clause in the settlement, but if the settlement is paid with tax dollars-which it will be-then it is a public record. They will have to release the info under a FOIA request.— October 14, 2010 7:23 p.m.

Kessler will make out very well, as will his lawyer. ===== If this gets anywhere NEAR trial the lawyer is going to make out MUCH BETTER than Kessler will. If the lawyer is smart he is billing out at $400-$500+ per hour, and billing for everything he can. Becuase this is an all or nothing deal on attorney fees, you need to build the hours up, because in this cases you can win you can average out for the cases that are lost. Like I said, I would not be surprised to see high 6 figure to low 7 figure lawyer fees and costs.— October 14, 2010 7:21 p.m.

I called it-if the judge OKed a deposition, he was not going to toss the case on a Sumamry Judgment motion. And since it won't be tossed, get ready for a confidential settlement at some point between now and the trial date. This case will NOT go to trial.— October 14, 2010 5:31 p.m.

If Judge Meyer allows the case to go to trial, I predict the City will settle with Kessler right away to protect Gerald "Pudge" Sanders from having to testify. Pudge may have to assert his fifth amendment rights if compelled to testify in order to protect himself from potential jeopardy in the Little Italy affair. ================== Sanders already has to testify, in the depostiion, so testifying at trial should produce no surprises, nothing new. San Diego’s pension fund expects to earn 7.75 percent a year
Gunny, as I recall you "retired" from the military with a full pension, and THEN went to work for SDPD, getting the military pension and the SDPD compensation- which is excellent in a good economy and as good as it gets in a down economy.. So if you were 38 when you started at SDPD you only need to put in 12 years in order to draw a SECOND pension. You put in your time in the military and most certainly deserve the military pension, b/c as RR pointed out it is very modest and even low given the danger involved, but you are under no obligation to work past 50 at SDPD. You make EXCELLENT compensation. If you do work past 50 it is because you are happy, like it according to you, and also get to keep building the SD pension. That is a deal 99% of the private sector would be willing to give their right arm for. Josh Gruenberg is going to be singing the happy song if he wins the SJ motion, and based on the fact that the judge has already ruled that Sanders could be deposed (which he certainly can-LA Mayor Richard Riordon was deposed under similar circumstances about 12 years ago) he has a good reason. Gruenberg knows that if he wins the case he is going to be able to have the City cover virtually all of his costs, which could easily total into the 7 figures, and that is just for HIS fees and costs, not counting any judgment liability-this is why you NEVER let a strong civil rights lawsuit get close to a SJ motion.— October 13, 2010 7:38 p.m.
