It is a ploy to reduce his prison sentence, plain and simple, just like James Malkus and G. Dennis Adams (one of those two-as stated above-was able to shave big time off his sentence, while the other had to serve out the whole sentence b/c he did not drink). I didn't say I agreed with the concept of using Blackwater to train SEALS -- I don't. But I simply can't think of anyone else in the Navy who would be a fit for this concept. ===================================== So you don't think the Navy has the personnel to do this job...Hmmm......but BW does. Burwell and Soshimo- i agree with both of you-this is being froced ontot he Navy-there is simply no other ligical explanation. When the best of the best, the Navy SEALS, have to use outside contractors to get "training", then we need to close up shop. It is that simple, and I don't buy it for a second. If your statement: "I think in the long run BW will be permitted to use the building for their business purposes though." turns out to be true, what's the point of appealing to the 9th District Court? =============================================== You seem to miss the BIG picture and the reason for the appeal-which I clearly outlined. BW may be right THIS TIME, but they still bypassed the process, and Huff allowed it. Next time the litigants may be WRONG, and then what wil the City do if Huff's bad ruling today allows for a bad ruling tomorrow????? I hate to say the City should appeal because the 9th Circuit is so over burdened and takes so long to rule, but the fact is Judge Huff has over reached her authority and needs to be over ruled so a precedent is not set, which would cause problems in future cases. Also, the case needs to be appealed so litigants like BW cannot prematurely bypass state courts. This case was simply not ripe for a federal review. That needs to be corrected. I think in the long run BW will be permitted to use the building for their business purposes though.— June 5, 2008 9:53 p.m.
