Don, Aguirre could file a Petition for a Writ of Cert. to the SCOTUS. That is discretionary with the high court. The first appeal to the 9th Circuit District Court of Appeals is "of right." A rehearing en bank at the Circuit Court is possible. Characterizing the real estate contracts as a "security" is an interesting argument. The question would become whether such securities require registration with the SEC is the key issue. Keep us posted. Diogenes cannot find the opinion yet. Schwarzenegger's sexual harassment history featured in Democrat's Issa hit
Arnold came from Austria. He then lived in Munich. My relatives knew him well there. He was said the be a street walker who strutted his stuff and sold supplements door-to-door. Arnold took steroids, and, as Governor, accepted a personal 10 million-dollar contract from Joe Wieder's body building magazine to hype Andro, a steroid precursor, a product sold by the magazine. Arnold returned 9 million but kept one-million for his trouble. This was the largest amount ever taken by a sitting governor while in office in California, illegally, mind you! Arnold publicly admitted to some real dog-pile action and multiple unwelcome gropings before the recall election!!!! I'm glad that Issa disapproves of Arnold now, because Issa bankrolled Arnold's run and Davis' recall. The recall of Davis was to save Enron money in the lawsuit against Enron. That's why Issa bankrolled Arnold. (Factoid, Arianna Huffington put some money into the recall as well. The mouthpieces were John and Ken at AM Clear Channel radio station KFI in Los Angeles, two well-known Republican apparatchiks). When Arnold allowed Enron off the hook in Davis's lawsuit in the energy arbitration, the state of California lost over 9 billion dollars. Arnold settled the case for 10 cents on the dollar whereas it was the clearest case of ratepayer manipulation of energy in history. The deregulation was accomplished in Texas by Bush 43 and his cronies. Owners of the Enron stock included Bush and Rove. Follow the money, folks. Same thing with developers right here in San Diego. To whose benefit? Republicans are so impressed with money and celebrity that they allowed Arnold in. He claimed that Indian Gambling would make up the shortfall in tax revenues. The budget never recovered, and education and public health suffered. But, but Filner ruined our beautiful City! yeah, sure right. I'll sell you a bridge in Brooklyn. It's always the same thing, the allegations about being "Gumby," in Davis' case. Bring in the big movie star. Overlook his background. Get the chorus crowing from the right. Yo! YankeeDoodle, The people of San Diego, and the press for the most part, could not care less about an injured lifelong resident of San Diego who was a federal public defender. If your are severely injured for life, the U-T doesn't care as much as butt-pinching because liability for the accident itself reflects poorly on ex-Mayor Sanders and present City Attorney Goldsmith. (Tax-cutting at public safety's expense). And, if they can dump Filner, they will go for high-density high-rise development in the suburbs and at the beaches, if they can change the law. I am certainly sympathetic to victims of a hostile work place due to sexual harassment, but it is disingenuous, to say the least, for these same people, who are to blame for "saving the taxpayers money", to wit: $300,000 in arborist fees for tree maintenance in our City causing severe injure an outstanding citizen of our City by their cheapskate tactics to save taxpayers money. The seven million paid out to the victim is only money; compare that to a ruined life. Is MCCormack-Jackson's life ruined? Hardly!!!!! The morality play of a sex scandal is far, far more interesting to the television-addicted readers of the U-T. Oh, how horrible, etc. etc., ad naseum. Putting things into proportion is good sometimes. Being in a wheelchair vs. have your butt pinched. Who is entitled to the million-dollar settlement? Mayor Sander's policies severely injured a very good man AND cost taxpayers money - much, much more money, if fact. Many accidents are caused by City potholes in the road. Politicly, it was too risky to raise taxes or borrow the money to fix the potholes in the roads. I know elderly women who feel down, breaking their wrists who required surgery. Most "Filner victims" were not job-related. McCormack has the only viable civil suit from what I see. The remainder are coroborating witnesses. The City faces a minor exposure compared to the Queen Palm case where Mayor Sanders administration pulled the plug on tree maintenance in the City to save money on queen palm maintenancer. The result? Goldsmith's attorneys got their clock cleaned at trial by my old friend, Brown Greene, California's premier trial attorney. I watched the trial in judge Styn's Department. The plaintiff settled for seven million because he was paralyzed from the waist down when the palm tree fell on him due to lack of maintenace by the City. Compare: McCormack had unwanted advances and a hostile work environment, allegedly. You need nine jurors for a verdict. Allred is no Browne Greene. She would lose half of the jurors because of her strident demeanor. She represented a close relative of mine 30 years ago.— August 13, 2013 10:48 a.m.
Ratepayers should pick up the tab for San Onofre closure, utility says
Sure, socialize the costs so SCE shareholders do not experience a loss. They should receive profits only since SCE has their political connections. One problem, Michael Aguirre is representing the ratepayers. In the seventies. A shareholder wrote to the board of SCE and Sempra Energy advising that, aa a long-term resident of San Clements, he had witnessed the demise of the original reactor, Big Blue. The decontamination from that took years. He urged that a gas-powered plant be installed instead. The response.was a visit by corporate honchos offering to purchase his shares at a premium, which he refused. Very sad situation. Since Nixon launched the war on drugs, there are higher profits for drug pushers. Free market principles would predict this outcome. Limiting the supply increases the price of the product. Getting people hooked becomes more profitable. Ditto with alcohol and tobacco.
