Yes, they reserve a date and then file and serve the Notice(s) and Motion(s) within the appropriate time periods. Filner will want to change venue and avoid giving testimony under oath as long as possible, hoping to avoid issues where he might have to take the Fifth in regard to things under possible criminal investigation as well as to avoid taking a definite position. Meanwhile, the case may be dismissed pursuant to possible settlement in mediation. McCormack-Jackson's attorney claims that she wants the money to come from Filner, etc. rather than the city, at least for his fees. Whatever. Motion to Quash Service of Process? In state practice, a Motion to Dismiss will be treated as a non-statutory Motion for Summary Judgment or a Motion for Judgment on the pleadings. In federal court, the Motion to Dismiss is used for many defects in the Complaint as well as for addressing many other defects in jurisdiction. Thanks, Don! I have had the degree from UCLA and must use it every day. Regarding politicians, and understanding voter behavior, We have to shift to behavioral anthropology and social psychology. Spaces does not permit but I have some ideas of why people follow those with such strong beliefs only to discover the leader's psychopathology. We must look to primate behavior for that explanation. The Alpha monkey hypothesis requires that the leader appear tough and certain of attitudes, values, and beliefs, even extreme ones. The authoritarian personality works best with right.wingers. In high conflict politicians we have basically five types: Narcissistic, Borderline, Paranoid, Antisocial, and Histrionic. These are enduring patterns of behavior, from early childhood and adolescence, with extreme behavior, extreme emotions, extreme thinking, interpersonal dysfunction, impulse control problems, which are outside of cultural norms. People with personality disorders lack awareness of why they are the way they are and how they contribute to their own problems. Masturbating is a public restroom is a criminal offense. Scott Peters - no pun intended - will certainly be able to hold his seat - again, no pun intended. Despite the failure of the U-T to cover this story, this will be circulated nationally on the Bill Maher Realtime and elsewhere. The U-T will be held to account for covering this up or not knowing about it when they endorsed DeMaio. I'll have to take Steve Erie out for a glass of wine to discuss the political ramifications. But the allegations seem to be credible and show a real problem with judgment and character. The issue is not one of sexual orientation but conduct that shows that sitting through a meeting is not possible without masturbation in a public restroom., if allegations are true.
