It appears from comparing the proposed remodel to the existing site, the major bone of contention is ALL entry is made from Dale street whereas now most probably enters from Upas street. Additionally, the site is flipped with all on site parking to the Dale side of the property, whereas today, all parking is on the East side of the property adjacent to the alley way and other commercial property. The new plan uses the public alley way, some might say, as it's private driveway for vehicles exiting the drive thru service window. Since the US Supreme Court has ruled corporation are people too, maybe Foodmaker, DBA Jack-in-the-Box, should be a good corporate citizen, and a good neighbor and consider its neighbor's health and welfare. Since the proposed plan would call for the lot to be scraped down to the dirt, its grandfathered exemptions should expire and, considering the proximity of the neighbors, no variance applied.— February 2, 2012 4:47 p.m.

I was just wondering if the Nails noticed the large fast food restaurant next door across the street when they made their offer on the home some 12 years ago? I'm also wondering in the last 12 years how many times they patronized the establishment, knowing it was only a few convenient steps away? With that said, if Foodmaker demolishes the existing structure then as discussed above all of the existing regulations should apply. You didn't see a photo because this monstrosity is, well... really ugly. "The vertical-axis turbine is approximately eight feet in diameter and is housed atop a 30-foot-tall base." Failure to Extend Payroll Tax Break, Jobless Pay Could Hurt, Says Economist
The question should be why did the Senate approve a Bill that extends the cut for two months. The House should send it back, changing the expiration date to Dec. 31, 2012 and see what the democratically controlled Senate and Executive Branch does. One only can wonder if that date in December is important. I've heard everything ends on 12/21/2012...just in time to ruin Christmas next year.— December 21, 2011 4:33 p.m.

Council to Consider Kessler Settlement
While not pleased at all with the loss of $200k as a settlement for bad decision making by the Mayor's office, it's better than the alternative. Rolling the dice with a trial/jury award which may have been higher was not a good idea. Sadly, once again, the Mayor has wasted more than the 200K reported. There were fees and expenses not included in the report. Now the questions should be about who is responsible, for this loss of the taxpayer's money, and what will be done about it?— November 16, 2011 6:30 a.m.
Council to Consider Kessler Settlement
It takes 10 years to vest with the City and if I remember correctly the purchase of airtime credits ended in July 2005. The confusion may be it only takes five years to vest in the County system. ------ Surfpuppy you wrote "Go teach KFC Sanders a lesson. Since Sanders "laid off" Kessler in his capacity as Mayor, the City, meaning the taxpayers, not Sanders personally, will pay the settlement or judgement. With the chances of a Jury awarding punitive damages against Sanders non existent the only ones being financial "punished" are City Taxpayers". And of course the only real winners are the lawyers, who get paid if the city wins or the city looses. Sadly, I'm not surprised by the two you you rooting for, and encouraging, the plaintiff to go to trial for mo money. It almost as if it's a sport. Especially when its OPM. Emptying the people's treasury on what may or may not be a dubious claim has become a new favorite pastime. While I have little respects for Sanders as Mayor, suggesting we dole out seven figure settlement is NOT a charity my government should be undertaking. Until such time when politicians are actually held liable AND accountable for their acts, the only ones who suffer the punishment of exorbitant settlements are the tens of thousands of taxpayers who fund the City's treasury, while Sanders laughs about it.— November 15, 2011 8:49 a.m.
