Well, yes . . . but the question is whether or not Cavner was negligent, the manufacturer didn't design the system properly, there was an error in the manufacture of the particular unit or batch of units, or the release pin got snagged on something and the fault can't be determined. It would be interesting to know how much the court relies on fact, possibilities, and probabilities in coming to its exalted conclusions rather than "expert opinion."— December 3, 2015 11:33 p.m.
