Build a stadium and Chargers will stay? Nope.
Oops, that should be "one of Thomas' former clerks."— May 10, 2012 9:25 a.m.
Dark Shadows: Dark Secrets, Grave Mistakes
I have not seen the movie, but the trailer looked pretty silly. I'd say we saw in *Warlock* and *Time after Time* ("Fries are pommes frittes!") most of the jokes (in concept) about Barnabas dealing with modern technology. And then it adds the double-whammy of showing us how "silly" the '70s were. Even in the trailer, the movie looks very self-conscious. You can almost hear the winks and the knowing grins. I wouldn't be surprised if there are shots with actors playing directly to the camera. The TV series may be comedic and campy in retrospect, but I took it at face value back then. I would enjoy a decently made dramatic *Dark Shadows* movie. But certainly much of that desire stems from nostalgia.— May 10, 2012 9:16 a.m.
Build a stadium and Chargers will stay? Nope.
During the recent session where the Court heard arguments on Obama's health care law, NPR interviewed on Thomas' former clerks. The man said Thomas does not say anything or ask questions because he's watching and listening. What a load of BS. The truth likely is that, like Rhenquist, Thomas pre-decides cases based on his ideology and politics, so there's no point in him wasting his time listening to the arguments. A written Thomas opinion is a real rarity.— May 10, 2012 9:05 a.m.

If you read his opinions and compare them to Thomas', you easily get the sense that Scalia actually thinks. Thomas is all knee-jerk (emphasis on "jerk"), like Rhenquist was. I read an article a few years ago regarding an attempt to come up with a *per se* definition of "activist judge." What the authors put forth was "a judge who votes to overturn legislative or executive actions." By that definition, at the time, the most activist judge on the Supreme Court was Thomas.— May 9, 2012 9:56 p.m.
San Diego as ground zero in the fight against incivility
Right or left, ridicule is ridicule. I don't listen to Stewart or Limbaugh, so my knowledge of what they say is from news reports. The last bit of poison I heard about from Limbaugh was him calling a woman a slut because she was advocating that insurance pay for birth control. I can only imagine it's possible to disagree with her and *not* call her a slut.— May 9, 2012 9:46 p.m.
Will Wall Street Cool on Bridgepoint?
Especially given the 15% tax rate they (that is, today's robber barons) pay on dividend income. Like Gordon Gecko, they *produce* nothing, they merely *own*.— May 9, 2012 9:43 p.m.

I would say that between the two options, "worthwhile degree and living allowance" or "worthless degree and living allowance," making the latter choice is irrational. Only if "worthwhile degree" is not an option does the "worthless" choice make any sense. And just because a worthless degree from a diploma mill is easier to get, that does not make it a more rational choice. Eating all one's meals at McDonald's is easier than cooking at home, but it's definitely not a more rational choice.— May 9, 2012 9:39 p.m.

"Our view of capitalism?" When has capitalism ever been about anything other then greed and personal gain? You acknowledge as much yourself your reference to "robber barons." Capitalism only works (to the extent it does work) when government is there to rein it in sufficiently. Unfortunately, ever since Reagan, those reins have been as slack as Ronnie's brain.— May 9, 2012 6:20 p.m.

I find it hard to reconcile your juxtaposition of the words "rational" and "worthless" in this context. If they need remedial help, they should get remedial help.— May 9, 2012 6:17 p.m.

Worse than that is *Chavez v. Martinez*, the subject of Alan Dershowitz' book *Is There a Right to Remain Silent?* The upshot of the decision is that right now, the only 5th Amendment limit on coerced statements is that they cannot be used against you in your own criminal prosecution. There's also some information regarding a statement from Scalia that innocence has no bearing on whether a punishment is cruel or unusual. Which I guess is probably true, since historically it has never been all that unusual to punish an innocent person. Wuf!— May 9, 2012 6:13 p.m.
