Giovanni’s defense attorney suggested that Nina was “ashamed and embarrassed” after she got drunk and had sex that day. Attorney Victor Orsatti said that a regretful teen sometimes “makes up things” after willingly participating in a sex party fueled by alcohol and drugs.

Superior court judge Richard Mills ordered all three defendants held on multiple felonies. Giovanni Abarca and Chica both face charges of aiding and abetting an act of sexual intercourse against the will of the victim, administering Ecstasy, and rape of an intoxicated person. They are both charged as adults. David Perez faces charges for possession of Ecstasy, marijuana for sale, and child abuse for allowing his toddler son to be within reach of drugs around his apartment. All three defendants are pleading not guilty to all charges. They are next due in the Vista courthouse on March 11.

The headline has nothing to do with the story-it needs to be changed.

Nina admitted that she drank from a large bottle of vodka while she was in the apartment that afternoon. She claimed that Chica told her to drink it. Nina said she took only two sips and she also smoked marijuana.

Sheriff’s detective Daniel Morsch interviewed Chica. Chica told him that she had been friends with Nina for some time. But then it developed that Nina had stolen a boyfriend from Chica. According to Morsch, Chica told him that “she wanted to get even with her.” Chica admitted, Morsch later said in court, that she had concocted a plot to get Nina “in a state” using drink or drugs and that she had arranged a meeting with “a guy named Gio.” Morsch said that Chica told him, “It was a setup.”

1- drugs and alcohol are serious problems for ANYONE, times that by 10 for teenagers.

2- "Chica" is a felonious slimball POS. She has already admitted she put drugs in the viticms drink, so it isd game over for her. The victim is a lousy witness because she was raped as a 16 year old by three slimeball dirtbags, but there is already enough evidence to lock all three dirtbags up for several years.

All three of the dirtbags are a serious threat to the public safety, if they plead or get convicted at trial I would throw every single one of them in the Joint for 10 years-maybe throw "Chica" in for 15 years.

One last comment, if "Chica" has been charged as an adult her name should be in the story just like the other two dirtbags names are.

"Chica" is being tried as an adult and as such there is no reason to sheild a slimeball sexual predator like her from the shame of the public light.

Why is the name of the high school not included? San Marcos High? Rancho Buena Vista High? Vista High? Or was it some sort of alternative "high school" or continuation school? If "Chica" lived on Smilax Road, that's in the San Marcos school district. For such a lengthy story, it is short on real information. And why was it posted two days before the next court proceeding? Wait until that's taken place, append the results to the story and post it then.
