Run over while sunbathing in Ocean Beach

A woman who was run over by a police department all-terrain vehicle while sunbathing in Ocean Beach has agreed to settle her lawsuit against the City of San Diego.

Court documents show that Christine Frear and the attorneys for the city filed for dismissal on September 11 of this year. The case is now on hold until city councilmembers can review the settlement.

Frear was sunbathing near a lifeguard tower in Ocean Beach on November 11, 2015, when a police ATV driven by Officer Jeffrey Martinez ran over her. Frear suffered a traumatic brain injury as a result of the collision.

Frear's attorneys filed a claim to the city's Risk Management Department for $900,000 in damages. The city denied the claim. Frear then filed her lawsuit in May 2016.

After more than a year of litigation the sides have reached an agreement. The terms of the settlement have not been released.

Frear's attorney and the city attorney's office declined to comment on the settlement.

City attorney spokesman Gerry Braun said he wasn’t able to confirm a settlement has occurred.

Attorneys for Frear did not respond to requests for comment.
