Vista father of four threatens his parents

Judge Harry Elias heard eleven cases June 2, in San Diego’s North County superior courthouse in Vista. One of the cases he heard was for Samuel Preciado Gutierrez Jr., 46.

Gutierrez has lived his whole life in San Diego County; he graduated from Carlsbad High School, and he has four children who live in Vista, the attorney told the judge. Gutierrez worked doing construction and piping, and lately he worked doing shipping and receiving at a warehouse. The “alleged victims” in the case are Gutierrez’s parents, she said, they live next door to him in San Marcos, and Gutierrez has agreed not to have any future contact with them. Gutierrez volunteered to give up his firearms if he could be released from custody.

“He is old enough to know better,” prosecutor Ryan Saunders declared. “He is old enough, he knows he shouldn’t be treating his parents like this.” The prosecutor said Gutierrez actually lives on his parents’ property. On the day of his arrest, Gutierrez was already out on probation because he had previously threatened his 69-year-old father. “His parents are afraid of him. The dad keeps a baseball bat near him at all times.” The prosecutor alleged, “He is constantly insulting them, and they believe he is constantly on drugs.” On that day two weeks ago, Gutierrez was pacing and yelling at his mother, the prosecutor said, “On that day he started calling her names then started threatening her, he said if she did not give him what he wanted she would not see past that day, then he threw two bullets at her, then he went outside and fired two rounds outside the house.”

Neighbors phoned police. When deputies arrived Gutierrez allegedly yelled a curse and sped off in a vehicle. His brother drove up, trying to catch up with Gutierrez, but the fugitive pulled out an assault rifle and was aiming it at his brother when he realized that cops were right behind him, it is alleged. Gutierrez then sped away. Eventually he bailed out of his vehicle, and then fought with officers trying to arrest him, the prosecutor claimed. Investigators found a loaded ammo magazine in the glove compartment, more ammo loose in the car, and an unregistered AR15 on the back seat.

Honorable judge Harry Elias set bail for Gutierrez at $205,000, and issued protective orders for three named persons, the mother and father and brother of Gutierrez. The defendant, who is described as 5 feet 9 inches tall and 220 pounds in jail records, pleads not-guilty to all charges and is next due in court on June 10.
