Disabled man says deputies beat him during misguided investigation

On December 11, Jeffory Fry filed a suit in federal court, claiming members of the San Diego County Sheriff's Department kicked, punched, and stomped on him, causing a trip to the hospital, because he was taking too long to put on his pants.

According to the suit, Fry, on permanent disability because of a lung disease, was sleeping in his Ramona bedroom nude on November 26, 2013. His live-in girlfriend, Pamela Dictaldo, was also in bed, wearing a nightgown.

Sheriff's deputies, looking for two men with felonies, broke into the house, says the lawsuit. Those two were in the process of moving out while Fry was moving in, according to the suit, which claimed that Fry was not wanted for any crime and was not subject of an investigation.

According to the suit, deputies complained that Fry was taking too long to put on his trousers. They threw him to the ground and kicked, punched, and stomped on him — causing physical wounds, including a bleeding head, for which he had to be treated.
