Callaway sued over Roger Cleveland trademark

Callaway Golf has been sued by Cleveland Golf Co. for trademark infringement and unfair competition.

Roger Cleveland sold his shares in the company named after him in 1990 and joined Callaway in 1996, according to Golf Digest. This July, Callaway came out with a wedge with the inscription, "DESIGNED BY ROGER CLEVELAND." So, Cleveland Golf recently sued Callaway and demanded it cease and desist using the Cleveland name.

The law firm of Milord & Associates, which specializes in intellectual property, says the use of one's surname is not a defense in a trademark-infringement action. Callaway refuses to comment.
