Murderer Gets 12 Years Added to Sentence for Stabbing Inmate

A man in jail awaiting sentencing for a murder stabbed another inmate and was sentenced on March 15 to 12 more years for the new offense.

Joaquin Martinez, a.k.a. “Jaws,” now 34, admitted causing great bodily injury with his jail-made “shank” when he attacked Drew Martin on September 22, 2010. In the plea deal, a charge of attempted murder was dropped.

Superior court judge Daniel Goldstein sentenced Martinez to 12 years in state prison for the stabbing, this term to run “consecutive” to the 28-years-to-life sentence Martinez got for murdering a woman in Oceanside.

A jury found Martinez guilty of killing 24-year-old Janina Hardoy, a woman who invited homeless people she found around Oceanside Pier into her home around the holidays in late 2004. In early 2005, parts of her body were found in a dumpster.

Martinez took the stand in his own defense and admitted chopping off her hands with a machete but claimed the woman had already died of a self-administered heroin overdose.

The jury declared him guilty of murder in May 2010, but legal maneuvering and flinging feces in jail delayed Martinez’s sentencing for that crime until January 2011.
