“The defendant said, ‘You better not say nothing you fucking bitch,” according to Sheriff’s Deputy Carlos Esquer. The deputy testified today against a man accused of battery and felony attempt to dissuade witness and spitting on a cop.

Farzad John Daftari, 22, listened to evidence against him in San Diego’s North County Superior Courthouse this morning.

The alleged crimes occurred on a Friday afternoon last month, when a 15-year-old boy identified as “Jake” and his 16-year-old friend were walking from Jake’s home in Encinitas, heading towards the beach. Jake said it was an unprovoked attack when Farzad John Daftari rushed him on a skateboard and suddenly punched the boy in the side of his head with a “closed fist.” The boy said he was knocked unconscious and went to the ground and “got a nice little bump” from the attack on July 20.

Someone phoned 911, the deputy said he responded to a “fight” call, and found Farzad John Daftari when onlookers pointed him out. Daftari told the deputy that blood on his shirt was the result of falling from his skateboard and that was no crime and he wanted to leave. But when the two teens approached the cop with the suspect, the deputy said Daftari put his finger to his mouth in a gesture of silence, and “Then he said, you better not say anything,” to the boys.

Deputy Carlos Esquer said that after Daftari was arrested, during the booking process, “He said, ‘I’ll be released in seventy-two hours and I’ll get that snitch.’” Daftari also threw wet toilet paper around his holding cell and spit into the deputy’s face from about one-foot away, the deputy testified.

The battery on the boy is charged as a misdemeanor and the spitting on the cop is charged as a felony. Daftari reportedly stated that he has hepatitis C, according to the deputy.

Daftari pleads not guilty to four new charges, and is held suspected of violating probation on a prior misdemeanor matter, and is scheduled to be back in court on September 5.
