Clerk Bloodied for Bag O' Peanuts

Carlsbad police officer Jamie Meroniuk said he was near the end of his shift, patrolling about 3 a.m. on a Thursday morning, when he saw two men on the sidewalk.

“One of the males frantically waved at me,” officer Meroniuk said. “One male looked like he was trying to stop the other male.”

The Carlsbad cop said he was making a U-turn to return to the men when he saw one man punch the other man in the face “with a closed fist.” The two men went down in the street by the time the cop was able to stop, “they were both on the ground in front of my patrol car,” he said. When the officer tried to intervene, one of the men started “swinging hay-makers” at his “mid-section,” the officer said.

“Mister Masedo essentially came after me,” the officer said at a preliminary hearing on August 1 2012, in San Diego’s North County Superior Courthouse. “We both tumbled to the ground at that point.” Although the cop said he told the man to “stop resisting,” he said “it was just continual hitting hitting hitting.”

Hugo Aruzco Masedo, 42, was arrested the morning of May 31, 2012 on suspicion of robbery and felony resisting arrest.

A clerk working inside the convenience store at a gasoline station on Pio Pico Drive in Carlsbad said he phoned 911 after he saw a man take a 20 ounce bottle of soda and a bag of peanuts from the store without paying. The clerk locked up the store and followed the man, he said he offered not to call police if the man would “give back” the stolen items. But the clerk testified that “He said, I don’t want to give it back, just let it go” and then “He started throwing punches at me.”

The clerk said he was able to retrieve the soda bottle in good condition but the $1.99 bag of peanuts got ruined in the street scuffle. Officer Meroniuk confirmed he saw the clerk’s face bloodied, “His lower lip was busted open from getting punched.”

Prosecutor Benjamin Barlow alleged that 42-year-old defendant Hugo Aruzco Masedo has prior convictions for assaults and drug charges, those are dated 2005 and 2006.

Judge Harry Elias ordered Masedo to face two felony charges and return to court August 29, 2012.
