The 3rd originally came together to play cover songs, but the trio soon began working on original music. They're currently in the process of putting together their first record, a 17-song concept album ton be titled Vicious Circle.

The band was originally called 4Play. However...

“We received a cease-and-desist letter from a lawyer on behalf of the jazz quartet Fourplay, telling us our band name 4Play was infringing on their mark and ‘causing confusion with the public,’” says singer/guitarist Brandon Hernández. The trio had been called 4Play since May 2005. “We were not aware that Fourplay existed…We did some research on the Web to make sure the demand was legitimate and learned that they’re a world-famous act with many fans and great commercial success.”

Hernández says his band never thought to check for other groups with similar names. “It was just a playful, semi-ridiculous handle we thought up when we were only a cover band. We originally came together to perform Green Day’s American Idiot punk-rock opera live. We don’t have any emotional ties to the name 4Play, [so] we contacted the law office and let them know that we would immediately change our name. We’ve shifted to almost all originals now, so a name change suits us.

“We’re only part-time rockers, anyways,” explains Hernández. “Our bassist, Pat Morris, is the head veterinarian at the San Diego Zoo. Our drummer, Scott Weldy, owns and operates his own exotic veterinarian practice. I was recently named the winner of the Food Network’s "Emeril Live Holiday Recipe Contest" and was flown out to New York City to be on an episode of Emeril Live" (the episode aired in December 2007).
