Kallie Lamb Helwig, 25, and Gerald Joseph Torello, 35, were summoned before a judge and ordered to stay away from three named persons, in San Diego’s North County Superior Courthouse today.

Helwig and Torello, both said to be five-year veterans with the Border Patrol, were ordered not to contact three witnesses who allegedly saw them commit lewd acts and then attack a woman at the Del Mar Fairgrounds last May.

The alleged victim had spoken to the same judge just yesterday, she said Kallie Helwig was the woman who hit her in the face with a closed fist while her companion Torello called out encouragement: “You can take her babe, I got your back.”

The alleged victim said she had suggested the two “get a room” when they were performing sex acts while seated next to her, in the audience during a Cirque du Soleil show on May 27 2012.

Judge Daniel Goldstein ordered all parties back to court on September 14 for a hearing to ready for jury trial or negotiate settlement.

They might actually go to trial? Who'd a thunk it? Even the vaunted Border Patrol has some bad apples? When the cops do wrong they can--belatedly--face consequences? Sorry for the string of questions. They will be answered in due course, or so we suppose. Torello looks very professional and reasonable in his blue dress shirt and black necktie. How about Helwig? Hardly looks like someone who could beat up on another petite Asian-looking female, does she? But there is the training that they get. And then mix that with alcohol, who-knows-what-drugs, and some sexual attraction, and whatta ya' get? Trouble, with a capital "T". Fascinating case.

Only 1 case in 20 goes to trial in felony cases- it is 1 in 150 in misdemeanor cases. So if a case does go to trial it means the case is extremely weak, and the majority of cases that actually do go to trial turn in favor of the defendant, usually with a straight up acquittal or conviction on lessor charges.

Since he DA in this case is asking for people who may have witnessed the incident it tells me this is a he said-she said case and the guilt will turn on whom the jury will believe, the accused or the alleged victim. Those odds are never good for a prosecutor, never. If no one steps forward then the case may be dropped or plea bargained down to nothing. The agents have their life and careers on the line b/c this type of crime will end the LE jobs.

I have to wonder what they mean by "sex act". If it is french kissing and some touching I would be hesitant to convict on any charges. If it is more than the DA may have a case.

I also wonder how two LE employees could act so irresponsible if the allegations are true.

If this is true they both should be fired ASAP, No one carrying a gun and the authority to use deadly force should be allowed to do this and stay employed.
