San Marcos man accused of stealing beauty cremes

Man reportedly wrestled to the ground for Oil-of-Olay and Loreal products

The “corporate security” man for a retail grocery store said he observed the customer put two jars of beauty crème into his jacket before he left the store, without paying for the items.

Witness Miguel Rivera testified that it was the evening of December 19 when he saw a man take one jar of Oil-of-Olay Regenerist Micro-Sculpting Cream and one jar of Loreal Age Defying Cream, from a store on East Mission Road in San Marcos. The witness characterized the items as “high-dollar-beauty-care” in sworn testimony.

Fifty-year-old Ervin Flood was wrestled to the ground outside the grocery store by two large security men, according to testimony in San Diego’s North County Superior Courthouse today.

Prosecutor Daniel Bahk alleges that the defendant has six prior felony convictions in San Diego County for theft crimes.

Judge Harry Elias took notice of “four existing felony grants of probation” when he denied a defense attorney’s request to reduce the new felony theft charge to a misdemeanor. The judge also revoked the probations today.

Ervin Flood, also known as Ervin Fludd, 50, pleaded not guilty today to the new theft charge, and is next expected in court February 5, 2013.
